1. Introduction

These Terms of Service govern the access to and use of the services offered under the Game Spirit brand.

Game Spirit provides professional and educational services related to artificial intelligence, automation, digital strategy, marketing, business development and operational transformation.

  • live webinars;
  • on-demand webinar replays;

  • workshops and training programs;
  • corporate training and advisory services;
  • related support and educational content.

By accessing the website, creating an account, registering for a webinar, purchasing a course, booking a consulting session or using any Game Spirit service, the user agrees to these Terms of Service.

If the user does not agree with these Terms, they must not access or use the services.

3. Scope of These Terms

These Terms apply only to the Courses, Webinars & Consulting services provided under the Game Spirit brand.

They do not apply to separate web agency services, including website development, ecommerce development, branding, marketing retainers, custom automation implementation or bespoke client projects, unless expressly stated otherwise in a quote, order form or agreement.

Separate terms, contracts or commercial conditions may apply to specific services. In case of conflict, the signed quote, order form, proposal, contract or specific service terms shall prevail over these general Terms.


4. Definitions

For the purpose of these Terms:

“Game Spirit” means the brand under which the courses, webinars, consulting services and educational resources are offered.

“User” means any person accessing the website, viewing free content, registering for a webinar, purchasing a course or using any service.

“Client” means any individual, company or organization purchasing paid services from Game Spirit.

“Consumer” means a natural person acting for purposes outside their trade, business, craft or profession.

Game Spirit may suspend or terminate access in case of misuse, unauthorized sharing, payment issues, fraud, security risks or breach of these Terms.


7. Courses

  • paid individual courses;
  • course bundles;
  • subscription-based access;
  • lifetime access;
  • time-limited access;
  • corporate training programs;
  • private or custom learning paths.

The exact content, duration, access period, price, included materials and support level are specified on the relevant course page, checkout page, commercial proposal or order confirmation.

Unless otherwise stated, access to a course is personal, non-transferable and limited to the registered user or authorized team members.

Game Spirit may update, improve, remove or reorganize course content to maintain quality, accuracy or relevance.


8. Webinars

Game Spirit webinars may be offered live, on-demand, free or paid.

Registration may be required to attend a webinar. Access details may be sent by email or displayed through the user account.

Game Spirit does not guarantee that a live webinar will remain available as a replay unless this is expressly stated in the offer.

Game Spirit may record webinars for replay, quality, training, marketing or internal purposes. By attending a webinar, the participant acknowledges that audio, chat messages, questions, comments or contributions may be processed as part of the webinar experience.

Participants must behave respectfully and must not disrupt the webinar, share offensive content, record the session without authorization, or distribute private access links.

Game Spirit may remove participants from a webinar in case of inappropriate behavior, misuse or breach of these Terms.


9. Consulting Services

Consulting services may include strategy sessions, audits, advisory calls, AI adoption guidance, automation planning, marketing strategy, operational recommendations, training or implementation support.

The scope, duration, deliverables, price, format and schedule of consulting services are defined in the relevant offer, booking page, quote, order form or written agreement.

Unless expressly agreed otherwise, consulting services are provided on a best-efforts basis and do not guarantee any specific commercial, technical, financial or operational result.

The client remains solely responsible for decisions, implementation, internal approvals, compliance, business outcomes and operational execution.


10. Workshops and Corporate Training

Workshops and corporate training sessions may be delivered online, in person, live, recorded, individually or in group format.

The client is responsible for ensuring that participants are available, equipped and authorized to attend.

Any cancellation, postponement, change of date or change of scope must be agreed in writing.

If a client requests substantial changes to the format, audience, content, duration or objectives of a workshop, Game Spirit may issue a revised quote or additional invoice.


11. Orders and Registration

An order, registration or booking is considered confirmed when:

  • the user completes the registration form;
  • the user accepts these Terms;
  • payment is successfully processed, where applicable;
  • Game Spirit sends confirmation by email or through the platform;
  • or a written commercial agreement is accepted.

Game Spirit reserves the right to refuse or cancel an order in case of pricing error, payment failure, suspected fraud, misuse, unavailability, abusive behavior or legal restriction.


12. Prices and Payment

Prices are displayed on the relevant offer page, checkout page, invoice, quote or commercial proposal.

Unless otherwise stated, prices may be displayed excluding or including applicable taxes depending on the user type, jurisdiction, sales channel and commercial context.

Payment may be required before access is granted, before a consulting session takes place, or according to the payment schedule specified in the quote or invoice.

Accepted payment methods may include card payment, bank transfer, online payment provider or any other method made available by Game Spirit.

Failure to pay may result in suspension, cancellation or refusal of access to the services.


13. Subscriptions and Recurring Payments

Some services may be offered through a subscription or recurring payment model.

The subscription terms, billing cycle, renewal conditions, included services and cancellation process are specified at the time of purchase.

Unless otherwise stated, subscriptions renew automatically at the end of each billing period.

The user may cancel future renewal according to the cancellation process provided. Cancellation does not automatically entitle the user to a refund for the current billing period unless required by law or expressly stated in the offer.


14. Consumer Right of Withdrawal

Where the user qualifies as a consumer under applicable law, they may benefit from a legal right of withdrawal for distance contracts, subject to the conditions and exceptions provided by applicable consumer protection rules.

For services, the withdrawal period generally starts from the day the contract is concluded.

For digital content not supplied on a tangible medium, the consumer may lose the right of withdrawal if they expressly consent to immediate access and acknowledge that this results in the loss of the withdrawal right, where this is permitted by applicable law.

Game Spirit may require the consumer to tick a specific checkbox before immediate access to paid digital content is granted.

Where the user acts as a professional client, withdrawal rights applicable to consumers may not apply.


15. Refund Policy

Refund conditions depend on the type of service purchased.

15.1 Digital Courses

Unless otherwise stated, access to digital courses is non-refundable once access has been granted, especially where the user has expressly requested immediate access and acknowledged the loss of the withdrawal right where applicable.

Game Spirit may, at its discretion, offer a satisfaction guarantee or refund period for specific courses. Any such guarantee must be expressly displayed on the relevant offer page.

15.2 Live Webinars

Paid live webinar registrations may be refundable or transferable only under the conditions stated on the webinar page.

If a replay is provided after the live session, missing the live event does not automatically entitle the user to a refund.

15.3 Consulting Sessions

Consulting sessions may be cancelled or rescheduled according to the rules stated in the booking confirmation or commercial agreement.

Unless otherwise stated:

  • cancellations made less than [48 hours] before the scheduled session may be non-refundable;
  • no-shows may be charged in full;
  • rescheduling is subject to availability;
  • repeated rescheduling may require additional fees.

15.4 Corporate Training and Workshops

Refunds, cancellations and postponements for corporate training and workshops are governed by the relevant quote, order form or contract.

Custom preparation work, strategy work, research, planning or content creation already performed may remain payable.


16. Rescheduling and Cancellation by Game Spirit

Game Spirit may reschedule, postpone or cancel a live webinar, consulting session, workshop or training due to technical issues, illness, force majeure, low attendance, platform failure or operational constraints.

Where possible, Game Spirit will offer an alternative date, replay, credit or refund depending on the type of service and applicable legal obligations.

Game Spirit is not responsible for indirect losses caused by postponement or cancellation, such as lost business opportunity, travel costs, missed deadlines or internal organizational costs, unless mandatory law provides otherwise.


17. Educational and Professional Disclaimer

The content provided by Game Spirit is intended for educational, informational, strategic and professional development purposes.

Game Spirit does not provide legal, financial, tax, accounting, medical or regulated professional advice unless expressly stated and provided by a duly qualified professional.

The user remains responsible for verifying whether the information, frameworks, recommendations, examples or workflows are suitable for their own context.

Results may vary depending on many factors, including the user’s business model, market, implementation quality, budget, team, tools, data, timing and external conditions.


18. AI and Automation Disclaimer

Game Spirit may provide training, examples, prompts, workflows, tutorials and recommendations related to artificial intelligence, automation, data tools, third-party platforms and software integrations.

AI tools and automation systems may produce inaccurate, incomplete, biased, outdated or unexpected results.

The user is responsible for:

  • reviewing AI-generated outputs;
  • validating workflows before production use;
  • complying with applicable laws and professional obligations;
  • securing confidential data;
  • respecting data protection requirements;
  • verifying third-party platform terms;
  • obtaining required approvals before deployment.

Game Spirit does not guarantee the availability, legality, performance, pricing or stability of third-party AI tools, APIs, software or platforms.


19. User Responsibilities

The user agrees to use the services lawfully, responsibly and professionally.

The user must not:

  • use the services for illegal, harmful or fraudulent activities;
  • copy, resell or redistribute Game Spirit content;
  • share private access links;
  • disrupt webinars, platforms or communities;
  • upload malicious code;
  • misuse AI prompts or workflows;
  • infringe third-party rights;
  • attempt to reverse-engineer protected materials;
  • harass instructors, speakers, participants or staff;
  • use the services in a way that damages Game Spirit’s reputation or infrastructure.

Game Spirit may restrict, suspend or terminate access if the user breaches these obligations.


20. User Content and Contributions

Users may submit questions, comments, messages, files, feedback, testimonials, case examples or other content during courses, webinars, consulting sessions or community interactions.

The user guarantees that they have the right to share such content and that it does not infringe third-party rights or confidentiality obligations.

By submitting content, the user grants Game Spirit a limited right to use it for the purpose of providing the services, responding to requests, improving the learning experience and maintaining records.

Game Spirit will not publish confidential business information as a public testimonial or case study without appropriate consent.


21. Testimonials and Case Studies

Game Spirit may request permission to use testimonials, success stories or case studies.

Unless the user has expressly agreed otherwise, Game Spirit will not publicly disclose confidential client information, sensitive business data or private implementation details.

Where a testimonial is submitted voluntarily, Game Spirit may use the name, role, company and feedback provided, subject to the consent given by the user.

The user may request removal or modification of a testimonial, subject to reasonable technical and operational constraints.


22. Intellectual Property

  • webinar recordings;
  • slides;

  • prompts;
  • frameworks;
  • guides;

  • visuals;
  • diagrams;
  • methods;

  • platform content;
  • brand names, logos and visual identity.

Unless expressly agreed in writing, purchasing or accessing a service does not transfer ownership of any intellectual property.

The user receives only a limited, personal, non-exclusive, non-transferable and revocable right to access and use the materials for their own learning or internal business purposes.

The user must not reproduce, resell, license, publish, distribute, upload, share, modify or commercially exploit Game Spirit materials without prior written authorization.


23. License for Professional Use

Professional clients may use the knowledge, methods and recommendations learned through Game Spirit services for their internal business operations.

However, they may not:

  • resell Game Spirit materials as their own;
  • package Game Spirit content into competing courses or trainings;
  • distribute templates to third parties;
  • remove copyright or brand notices;
  • present Game Spirit frameworks as proprietary materials;
  • use recordings or slides for public training without authorization.

Specific extended licenses may be granted through a written agreement.

During consulting, training or workshops, either party may receive confidential business, technical, strategic or operational information.

Each party agrees to protect confidential information and not disclose it to unauthorized third parties, unless disclosure is required by law or necessary to perform the agreed services.

Confidentiality obligations do not apply to information that is publicly available, already known, independently developed or lawfully obtained from another source.


25. Third-Party Tools and Platforms

Game Spirit services may rely on or refer to third-party tools, including webinar platforms, learning management systems, payment providers, AI tools, analytics platforms, automation software, CRM systems, email tools or cloud services.

These third-party services are governed by their own terms, privacy policies, pricing and technical conditions.

Game Spirit is not responsible for changes, outages, errors, data loss, price changes, account restrictions or policy changes caused by third-party providers.


26. Availability and Technical Access

Game Spirit makes reasonable efforts to ensure access to digital services.

However, access may be interrupted or limited due to maintenance, updates, technical failures, cyber incidents, platform changes, hosting issues, internet disruptions or force majeure.

Game Spirit does not guarantee uninterrupted, error-free or permanent access to the website, platform, courses, webinars or resources.

Game Spirit shall not be liable for delay or failure to perform caused by events beyond its reasonable control.

Such events may include technical outages, internet failure, cyberattack, illness, accident, strikes, supplier failure, platform outage, government action, natural disaster, war, pandemic, power failure or any other event that prevents normal performance.


31. Suspension and Termination

Game Spirit may suspend or terminate access to the services if the user:

  • fails to pay;
  • shares access without authorization;
